Mediation
Disputes amongst parties can be incredibly stressful and can also take a significant amount of time and cost in reaching a resolution. Mediation ensures that a neutral and impartial person assists the respective parties in resolving the dispute at hand, enabling the parties to reach a mutually agreed settlement.

Mediation is a voluntary form of alternative dispute resolution (ADR) and is the process of resolving a dispute between two, or more people.

The mediation process involves the respective parties to the dispute attending mediation. The mediation process tends to be over a full day and provides the respective parties with a cost-effective option to resolve the dispute at hand, or at the very least significantly narrow the matters in dispute.
Expert Witness
Our specialised team are regularly instructed to provide evidence as an expert witness in property dispute claims across all courts and jurisdictions. At JEC, we have a team of senior property experts that regularly provide valuation advice to some of the Cayman Islands forefront legal practitioners.

JEC’s specialist advisory team provide independent, impartial and unbiased evidence to the court or tribunal. Our team are all RICS Chartered Surveyors and have required training and expertise to be viewed as experts in matters of property valuation in the eyes of the Law.
Arbitration
A contract or lease may state that disputes relating to service charges should be dealt with by arbitration. Alternatively, the parties may agree to go to arbitration irrespective of what the lease provides.

Arbitration should be regarded as an alternative type of court with the arbitrator setting down rules for disclosure of expert evidence and documents. Unlike court proceedings, the result of arbitration can stay confidential.

The arbitrator may be agreed upon by the parties or in default by a professional body such as Cayman Islands Association of Mediators and Arbitrators or the RICS. When it comes to issues involving major works or service charge accounts the arbitrator would tend to have experience of property and/or litigation. With minor exceptions the decision of an arbitrator will be final and binding.
